1. Agreement to Terms

By accessing or using Pixipie ("we," "us," or "our") and our AI-powered marketing platform services, including but not limited to Post Creator, Pixi AI Campaign, Social Connecter, Smart Insights, Pixi Copilot, and Chat Agent (collectively, the "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms constitute a legally binding agreement between you and Pixipie. We may update these Terms from time to time, and your continued use of the Service after such changes constitutes acceptance of the updated Terms.

2. Description of Service

Pixipie is an AI-powered marketing platform that provides the following services:

• Post Creator: AI-powered content generation for social media posts
• Pixi AI Campaign: Automated social media workflow management with content generation and scheduling
• Social Connecter: Integration and management of multiple social media platforms (Instagram, Facebook, LinkedIn, etc.)
• Smart Insights: Analytics and performance metrics for content and campaigns
• Pixi Copilot: AI content assistant for content suggestions and optimization
• Chat Agent: AI-driven messaging automation (e.g., WhatsApp integration)

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.

3. User Accounts

A. Account Registration

• To use certain features of the Service, you must create an account by providing accurate, current, and complete information.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must be at least 16 years old to create an account. Users under 16 may only use the Service with parental consent and supervision.
• You agree to notify us immediately of any unauthorized use of your account.

B. Account Responsibilities

• You are solely responsible for all content created, posted, or published through your account using the Service.
• You must comply with all applicable laws and regulations when using the Service.

• Attempt to gain unauthorized access to any portion of the Service or any other accounts, systems, or networks
• Use automated systems (bots, scrapers, etc.) to access the Service without our express written permission
• Reverse engineer, decompile, or disassemble any portion of the Service
• Use the Service to spam, phish, or engage in any form of unsolicited communication

5. Subscription and Payment

A. Subscription Plans

• Pixipie offers various subscription plans, including free trials and paid plans (monthly or annual).
• Subscription fees are billed in advance on a recurring basis according to your selected plan.
• All fees are non-refundable except as expressly stated in our Cancellation & Refund Policy.

B. Payment Terms

• You agree to provide current, complete, and accurate payment information.
• By subscribing, you authorize us to charge your payment method for all fees associated with your subscription.
• If payment fails, we may suspend or terminate your access to the Service.
• All prices are subject to change with notice. Existing subscriptions will be honored at the original price until renewal.

6. Intellectual Property

A. Our Rights

• The Service, including all software, designs, graphics, text, and other content, is owned by Pixipie or its licensors and is protected by copyright, trademark, and other intellectual property laws.
• You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

B. Your Content

• You retain ownership of all content you create, post, or publish through the Service ("Your Content").
• By using the Service, you grant Pixipie a worldwide, non-exclusive, royalty-free license to use, store, and process Your Content solely for the purpose of providing and improving the Service.
• You represent and warrant that you have all necessary rights to grant this license and that Your Content does not violate any third-party rights.

7. Third-Party Services

• The Service integrates with third-party platforms (e.g., social media platforms, payment processors). Your use of these third-party services is subject to their respective terms and conditions.
• We are not responsible for the availability, accuracy, or reliability of third-party services.
• You are responsible for maintaining your accounts and credentials for third-party services connected to Pixipie.

8. Disclaimers and Limitations

A. Service Availability

• The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We do not guarantee that the Service will be uninterrupted, error-free, or secure.
• We are not responsible for any loss of data, content, or functionality resulting from your use of the Service.

B. Limitation of Liability

• To the maximum extent permitted by law, Pixipie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• Our total liability for any claims arising from the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pixipie, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your Content
• Your violation of these Terms
• Your violation of any third-party rights

10. Termination

• We may suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason, including violation of these Terms.
• You may terminate your account at any time through your account settings or by contacting us.
• Upon termination, your right to use the Service will immediately cease, and we may delete your account and data in accordance with our Privacy Policy.
• Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.
